Crime & Motoring Law Barrister | 15+ years experience

Peter Gotch

Peter Gotch is direct access barrister and outright criminal and regulatory offences specialist. He had a career as a police officer before he qualified as a barrister, serving for 15 years with Thames Valley Police, including working on the Traffic Department.

His direct experience of police procedure and the law applicable to motoring makes him an ideal choice for defending clients being prosecuted for motoring offences but he also accept instructions to advise and defend clients faced with serious criminal and regulatory charges in the Crown Court.

Biography

After leaving the police force with a BSc (Hons) in Police Studies Pete returned to university and took a post graduate diploma in Law. In the following years he qualified as a Barrister. He was called to the Bar at Lincoln's Inn in 2005.

He has experience working as both a Solicitor and a Barrister on a large variety of serious criminal, regulatory and traffic cases. Now in his 17th year of defence work Pete prides himself on providing high quality advice and representation to direct access clients. Pete's workload tends to involve the following charges:

Criminal offences including:
    • Public order offences
    • Assault
    • Sexual offences
    • Drugs Offences
    • Fraud

Quasi-criminal regulatory offences (e.g. Trading Standards, Council Tax offences and Local Authority Prosecutions)

  • Abuse of process arguments

  • Driving offences:
    • Speeding
    • Driving under the influence of alcohol and drugs
    • Driving without insurance
    • Careless driving
    • Dangerous driving
    • Failure to provide
    • Failing to stop at the scene of an accident
    • Driving whilst using a mobile phone

In addition to his busy practice dealing with serious criminal offences in the magistrates and crown courts, Pete has an excellent track record of defending clients charged with motoring offences before the magistrates' court.

He can accept instructions to advise on plea/defence, mitigate for clients in sentencing hearings to try to avoid disqualification, advance exceptional hardship arguments and provide robust representation in contested trials. In addition to his specialist motoring offence practice, Pete has substantial experience representing clients faced with criminal matters. He regularly deals with public order, assaults, drug offences as well as fraud and sexual offences.

Abuse of Process

As part of his wider criminal practice, Pete accepts instructions to represent clients in relation to abuse of process arguments. This is a niche area of practice for Pete and he has achieved some notable results on behalf of clients. Media coverage of one such example can be seen here.

Pete still considers himself to be a petrol head and loves his fast cars and motorbikes. He is a class one advanced driver and motorcycle instructor.
